At Just Add Plants we want all of our customers to have peace of mind when they shop online with us. These retail online sale Terms & Conditions explain how purchases made through our website work, including orders, payment, delivery, product information and your rights as a customer.

These Terms apply to retail purchases made through the Just Add Plants website when buying goods for personal, domestic or household use and all Just add Plants promotions and giveaways. Our Trade and Wholesale Terms & Conditions are available on our Trade & Wholesale page here.

These Terms apply to purchases from Just Add Plants Pty Ltd ABN 82 600 674 253 of Geebung, Queensland (Just Add Plants, we, us, our).

About these Terms

• These Terms apply to the sale of goods by Just Add Plants through our website to retail customers.
• These Terms apply together with any order confirmation, product description, Shipping Policy, Returns Policy and other written information we publish on our website.
• If there is any inconsistency between these Terms and a more specific written statement issued by Just Add Plants for a particular order, the more specific written statement will prevail to the extent of that inconsistency.

Pricing and payment

• All prices are in Australian dollars unless stated otherwise.
• All prices include GST unless stated otherwise.
• Delivery charges are not included in the prices shown.
• Delivery charges, if applicable, will be shown at checkout.
• Full payment is required before dispatch unless Just Add Plants agrees otherwise in writing.
• We may change prices from time to time, but any price change will not affect an order already accepted by Just Add Plants.
• If an obvious pricing error is identified before dispatch, we may contact you to confirm whether you wish to proceed at the correct price. If you do not wish to proceed, we will cancel the affected order and refund any amount already paid for that order.

Product information, images and variations

• Product images, dimensions, finishes, colours and descriptions are provided in good faith.
• Because many of our products are handcrafted, hand finished, batch made, or produced using natural materials and processes, reasonable variations may occur.
• Samples, swatches and photography are intended as a guide only and may not exactly replicate the final supplied product.
• Due to the nature of handmade, hand finished and natural material products, variations may occur in shade, tone, texture, markings, veining, gloss level, shape, dimensions, weight, surface finish and general appearance. Minor scuffing, small surface irregularities, minor hairline surface cracking, and ordinary variation between batches may occur and will not, of themselves, mean the goods are faulty.
• Depending on the material and environment, goods may expand, contract, weather, mark, stain, fade, discolour, or show ordinary wear over time through exposure to sun, rain, water, soil, plant matter, fertilisers and normal outdoor use. Ordinary weathering or ageing of this kind is not, of itself, a defect.
• You are responsible for satisfying yourself that the selected goods are suitable for your intended application, site conditions and use.

Orders

• When you place an order through our website, you are making an offer to purchase the goods in that order.
• An order is not binding on Just Add Plants until we accept it.
• We may accept an order by sending an order confirmation, issuing a tax invoice, or dispatching the goods.
• From time to time, we may need to decline or cancel an order before dispatch, including where:
• the goods are unavailable,
• there is an obvious pricing or product description error,
• there is an issue with payment, billing or delivery information,
• the order appears unusual or potentially fraudulent, or
• we are otherwise reasonably unable to fulfil the order.
• If we cancel an order before dispatch and payment has already been made, we will refund the amount paid for the cancelled goods.

Special orders and made to order goods

• Just Add Plants may offer custom made, specially sourced, indent, made to order or manufacturer order goods.
• Just Add Plants may require a deposit or full payment for those goods before the order is placed.
• Once Just Add Plants has placed the order with the manufacturer or supplier, that order cannot be cancelled by you.
• Custom made, specially sourced, indent, made to order or manufacturer order goods are generally non-returnable unless required by law or unless Just Add Plants agrees otherwise in writing.

Delivery and freight

• Delivery is subject to our Shipping Policy.
• Delivery dates and lead times are estimates only.
• We use all reasonable efforts to meet estimated dispatch and delivery timings. Even so, delays can sometimes occur due to stock availability, supplier timing, freight network issues, weather events or other matters outside our reasonable control.
• Risk in the goods passes to you on delivery, or, if you arrange your own collection or carrier, at the time of collection by you or your appointed carrier.
• Title to the goods does not pass to you until Just Add Plants has received payment in full for those goods.

Inspection and transit issues

• You should inspect the goods as soon as reasonably practicable after delivery or collection.
• If there is visible transit damage, short delivery, supply of the wrong goods, or another issue that ought reasonably to have been apparent on inspection, you should notify us in writing within 48 hours after delivery or collection.
• If you become aware of a latent defect or concealed issue, you should notify us in writing within 7 days after becoming aware of it.
• Any claim should include reasonable supporting information, including photographs, invoice or order details, delivery date and a description of the issue.
• You should not dispose of, alter, install, repair or otherwise deal with goods that are the subject of a claim unless:
  a) we agree in writing, or
  b) it is reasonably necessary to prevent safety risk or further damage.
• To the extent permitted by law, Just Add Plants may decline a claim for visible damage, wrong goods or other matters that ought reasonably to have been apparent on inspection if the goods have been installed, altered, modified or otherwise dealt with before Just Add Plants has had a reasonable opportunity to review the claim.

• Competition closes at 5PM AEST 13th of June 2026. The winner will be contacted via email and announced on our social media (IG: just.add.plants) on the 14th of June 2026.
• Competition is exclusive to attendees/ticket holders of the Design Show Australia. Limited to Australian residents only, aged 18+.
• One entry per attendee/ticket holder.
• Delivery details will be required and the product will be dispatched and delivered within 5-7 days dependent on location within Australia.
• Prize is valued at AUD $598.00 and consists of two empty lightweight, fiberglass plant pots sized 50cm H x 39cm W and 65cm H x 39cm W in matte white only.
• Prize cannot be exchanged for cash or alternatives.

• These terms and conditions form part of the Agreement between You and Us. By accessing this website and/or undertaking any particular activity, such as placing orders or submitting forms, indicates Your understanding, agreement to and acceptance of the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.

Returns and refunds

• At Just Add Plants we offer a two-year warranty from purchase date on all of our new products subject to our returns and refunds policy.
• Just Add Plants may, at its discretion, accept ‘change of mind’ returns in limited circumstances as set out in the Returns Policy.
• Custom made, specially sourced, indent, manufacturer order, clearance, discontinued or made to order goods are generally non-returnable unless required by law or agreed by us in writing.

Australian Consumer Law

• Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
• Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
• If a product fails to meet a consumer guarantee, you may be entitled to a repair, replacement or refund, and in some cases compensation for other reasonably foreseeable loss or damage, depending on the nature of the failure and your legal rights.
• Where the law permits Just Add Plants to limit its liability in relation to a non-excludable guarantee, Just Add Plants’ liability is limited, at its discretion, to:
  a) replacing the goods,
  b) repairing the goods,
  c) paying the cost of replacing the goods, or
  d) paying the cost of having the goods repaired,

Product suitability, care and installation

• You are responsible for ensuring that the goods are suitable for the intended site, application and end use.
• Just Add Plants does not provide engineering, structural, drainage, waterproofing, landscaping or installation advice.
• Any recommendation or comment we make is general in nature.
• Where Just Add Plants provides product care, drainage, installation, handling or maintenance instructions, whether on the website, in product materials, or otherwise in writing, you are responsible for ensuring those instructions are followed and are suitable for the circumstances in which the product is to be used.
• To the extent permitted by law, Just Add Plants is not responsible for damage, deterioration, finish issues, drainage problems, structural issues or reduced product life caused or contributed to by your handing of the goods and the circumstances in which you handle the goods.
• To the extent permitted by law, Just Add Plants is not responsible for issues arising from modifications made after supply, including drilling, cutting, painting, sealing, filling drainage holes, connecting the goods to drainage systems, or any other alteration.

Limitation of liability

• To the fullest extent permitted by law, and subject to clause above Product suitability, care and installation, Just Add Plants is not liable for indirect or consequential loss, loss of profit, loss of opportunity or loss of revenue arising out of or in connection with the supply of goods, delay in supply, or use of the goods.
• To the extent permitted by law, Just Add Plants is not liable for costs associated with removing, uninstalling, disposing of, reinstalling or replanting goods, soil, plants or associated materials, or for labour, access equipment, contractor costs or similar expenses arising from or in connection with a claim relating to the goods, except to the extent liability cannot lawfully be excluded.
• Clauses 11.1 and 11.2 do not apply to liability arising from Just Add Plants fraud, wilful misconduct, or any liability that cannot lawfully be excluded or limited.

Privacy

• Just Add Plants collects, uses and discloses personal information in accordance with its Privacy Policy.
• Just Add Plants may use cookies and similar technologies on its website. Further information about how Just Add Plants collects and handles personal information is set out in the Privacy Policy.

Website use

• Just Add Plants owns, or is licensed to use, the content on its website, including text, product images, branding, graphics and other materials.
• You must not copy, reproduce, republish or exploit website content for commercial purposes without Just Add Plants prior written consent.
• Just Add Plants website may contain links to third party websites. Those links are provided for convenience only. Just Add Plants is not responsible for third party websites, their content, or their privacy practices.

Force majeure

• Just Add Plants is not liable for delay or failure to perform to the extent caused by events beyond our reasonable control, including supplier delay, shipping disruption, freight interruption, natural disasters, industrial action, pandemic related events, systems outages, government action or severe weather.
• Where such an event occurs, Just Add Plants will use reasonable efforts to minimise disruption and resume performance as soon as reasonably practicable.

Changes to these Terms

• Just Add Plants may update these Terms from time to time to reflect changes to our business, systems, supply arrangements or legal obligations.
• We will publish updated Terms on our website. Updated Terms will apply to orders placed after the effective date of the updated Terms.

General

• These Terms are governed by the laws of Queensland, Australia.
• The parties submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from those courts.
• If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down to the extent necessary or, if that is not possible, severed, and the remaining provisions will continue in full force and effect.
• A failure or delay by either party to exercise a right does not waive that right.
• These Terms constitute the entire agreement between the parties in relation to their subject matter, except to the extent of any specific written agreement signed or otherwise agreed by both parties.
